The Platform, under no circumstance, will be liable for any damages, losses, or injuries as a result of anything generated by third party content on the Platform, or any of its affiliates.
YOU AGREE, CONSENT AND ACKNOWLEDGE THAT YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY KIND RESULTING FROM THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY FORM, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. DO NOT PROCEED IF YOU DO NOT AGREE WITH THE TERMS LAID OUT IN THIS DOCUMENT. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES WHATSOEVER. YOU EMPLOY THE PLATFORM AT YOUR OWN RISK, AND UNDERSTAND THE RISKS INVOLVED IN USING SUCH A PLATFORM.
YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES TO YOU ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU, OR BY SOMEONE ON YOUR BEHALF THROUGH THE PLATFORM IN THE 3 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.
In order to allow the limitation of liability above, the limitation will be modified in a manner aimed at making it comply with applicable law, if the applicable law does not allow the limitation of liability. The limitation of liability clause shall survive the termination or expiration of the agreement provided.
By employing, or interacting with the Platform, you agree, confirm and acknowledge that you are legally able to consent and receive these services. If you are under the age of 18, you agree, consent and acknowledge that you have the consent and permission of a parent, or a legal guardian to access these services, and that you are legally able to enter into a contract on the platform and its affiliates.
You agree, confirm and acknowledge that all information provided by you (and your parent, or legal guardian if you are under the age of 18) including the information that you provide throughout your usage of the Platform in its entirety, is accurate, current and complete. You agree to update any information as it becomes known to you in order to ensure the accuracy and integrity of your personal information.
You acknowledge that you, and only you, are responsible for maintaining the confidentiality of your password, and any other private information related to your personal account. We suggest that you change your password frequently in order to ensure the security of your password. You agree to never share your password with any other individual. If you know, or suspect, that your password has been compromised, you agreed to notify the Platform of this breach in privacy. You agree to notify us if anyone is able to access your private account.
You agree, confirm and acknowledge that the Platform will not be liable, and you will hold us harmless, for any loss or damages incurred from another individual accessing your account—whether with or without your consent and/or knowledge.
You agree, confirm and acknowledge that you, and only you, are fully responsible for any activities which occur on your private account. You also acknowledge that the platform will hold you accountable for any damages, or loss as a product of another individual accessing your private account—whether with or without your consent and/or knowledge. You agree to indemnify, and hold us harmless for any damages or losses associated with the unauthorized access of your private account by anyone. You also agree to, under no circumstance, access the account of another individual for any reason. You may only use your personal private account.
You agree, confirm and acknowledge that you are solely accessing the platform for any reason regarding your own personal needs. You may not access the platform and services for, or on behalf of anyone other than for your own personal needs.
You agree, consent, and acknowledge that you will never intentionally interfere, disrupt, or attempt to interfere or disrupt any of our systems, services, connections, servers, infrastructure and communication systems.
You agree, consent and acknowledge that you may not use the platform, under any circumstance, to send:
(a) unsolicited emails, or advertisement of anything (b) malware or software containing bugs
(c) obscene, threatening, harassing, vulgar, invasive, abusive, racist, or potentially harmful behaviour, or unlawful behavior
(d) engage with, or post any third party content that infringes upon IP rights
(e) engage with, or post any content that may lead to damage, or loss for a third party
(f) engage with, or poster any content which may cause, or encourage criminal activity, or break any relevant law
You agree, by use of the Platform, to not engage in any activity that would violate any local, state, national or international law, or ethical code.
You agree to first scan any files sent to you through the Platform, or not, for malware, or software containing viruses, prior to opening this file.
You agree, consent, and acknowledge to indemnify the Platform, and hold us harmless from any losses or damages, liabilities, demands my liabilities and expenses including litigation and attorney fees arising from any of the following:
(a) your engagement access to the Platform to any degree
(b) any actions which may have occurred through your account – whether through you, or someone else— weather with, or without your express consent, and/or knowledge
(c) your breach of any of the clauses in this Agreement
(d) failure to pay, or, in the event of a minor, failure for your parent, or legal guardian to pay for services through the Platform
(e) your breach of any third-party right, including, but not limited to, intellectual property, publicity, confidentiality, property, or privacy. This clause shall survive expiration, or termination of this Agreement.
You confirm that all payment methods will be your personal payment methods, and represent legal accurate and updated payment methods. You allow us to charge you through the means of payment you provide on the Platform. All payment information must be accurate and valid.
You understand, agree and acknowledge that the Platform has the legal right to disrupt, discontinue and/or permanently ban you from using the Platform at any time without notice to you. We will not be liable for any losses, damages or inconveniences, which may arise from the actions listed above. The Platform may discontinue your access to the Platform for any reason, with, or without cause.
You understand that, while we invest heavily in providing a quality, and dependable platform, the platform may not always be accessible, reliable, and efficient. You acknowledge that your access to the platform may be interrupted at times, but that we will work to resolve these issues expediently.
You agree to allow the platform to communicate with you via email in order to make you aware of relevant details pertaining to the Platform.
THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND US. YOU CONFIRM THAT YOU HAVE NOT RELIED UPON ANY PROMISES OR REPRESENTATIONS BY US EXCEPT AS SET FORTH IN THIS AGREEMENT.
You agree to be bound by the most recent version of the terms of service and privacy policy.
The most recent version of these documents supersedes any previous versions of these documents. If you do not agree with the terms provided in these documents, do not employ our platform.
Cease use of the platform immediately if you do not agree with all terms in the Terms and Conditions and Privacy Policy. Please email us by clicking on the "contact us" tab at the bottom of our website if you do not understand any clause in the Terms and Conditions and Privacy Policy.
If any clause of this Agreement is held by a court of competent jurisdiction to be illegal, invalid, or otherwise contrary to law, all remaining provisions of this Agreement will remain valid.
All clauses regarding limitations of liabilities and indemnification shall survive the termination, or expiration of this Agreement.
